TERMS AND CONDITIONS FOR STAR DAPPLE

These terms and conditions (“Agreement”) govern your use of Star Dapple, an online platform for the distribution and sale of model horse-related items (“Service”). By using the Service, you agree to comply with and be bound by the terms and conditions stated herein. If you do not agree with any part of this Agreement, please refrain from using the Service.

  1. Definitions:
  2. Website (Service) or stardapple.com – an online platform operated by Star Dapple SRL and accessible through the stardapple.com domain.
  3. Provider or StarDapple – the company SC Star Dapple SRL, referred to as “Star Dapple” or “us,” a limited liability company registered and operating in accordance with Romanian legislation. Our registered office is located in the Municipality of Galati, registered with the Trade Register under no. J17/286/20.02.2023. The company is represented by Iordache Denis– Administrator, who can be contacted via email at contact@stardapple.com.
  4. Regulation – this document, along with its annexes, establishes the rules for using the Website. The current version of the Regulation is always available on the Website and can be downloaded, saved, or printed.
  5. Visitor – an individual who uses the Website without having an Account or being logged in.
  6. User – any individual who is at least 18 years old, has full legal capacity, and uses an Account Service after logging into their Account. This includes authorized individuals and legal entities.
  7. Account – a collection of data associated with a specific User, including information about their activity on the Website provided by the User.
  8. Registration – the process of creating an Account by a User after providing their data, accepting the Regulations, and activating the Account.
  9. Buyer – a User who engages in transactions with the Seller using the functions of the Website.
  10. Advertisement – a proposal, created by the Seller, to sell or make a Product available.
  11. Product – goods or services that are the subject of an Advertisement.
  12. Delivery – a transport service provided by professional courier services for the goods involved in a Transaction.
  13. Seller – a User who publishes an Advertisement on the Website and conducts Transactions with Buyers.
  14. Transaction – any agreement between a Buyer and Seller regarding a specific Product.
  15. Paid Services – services provided by Star Dapple to the Seller for which a fee is charged.
  16. General provisions:
    1. The terms and conditions for using the Website, including rules for registration, Advertisement publication, payment aspects, and complaint procedures, are outlined in the Regulations. Any person using the Service must familiarize themselves with the content of the Regulation.
    2. Visitors can utilize limited functions of the Service as outlined in these Regulations, while complying with the law and principles of integrity.
    3. The content published on the Service, including Announcements in various formats such as text, graphics, and videos, is protected by Copyright Law no. 8/1996, as amended, and other applicable laws pertaining to intellectual and industrial property rights of STARDAPPLE SRL, Sellers, and third parties. Any use of this content without written consent from the authorized individuals is prohibited. Aggregating and processing data and information from the Website for further distribution to third parties on other platforms, including offline sources, is prohibited. The use of the Website and STARDAPPLE SRL insignia, including its distinctive graphic elements, is also prohibited without the express and prior consent of STARDAPPLE SRL.
    4. The following actions can be performed within the Website:
  • Browsing the Website’s content;
  • Using the Account and related features
  • Publishing Advertisements
  • Chatting with other Users to conduct Transactions
    1. Browsing the content is free. Using the Account services, and publishing Advertisements is NOT free of charge. Star Dapple offers a variety of account types to best serve the needs of its Sellers. The Buyer’s services are free.
    2. Delivery and payment services are provided by external service providers under separate legal relationships, in which STARDAPPLE SRL is not a party.
    3. To fully utilize the Website, you must have an Internet-connected device that meets the following requirements:
  • Active Internet connection enabling two-way communication via the HTTPS protocol
  • Up-to-date, properly installed, and configured web browser supporting the HTML5 standard and Cascading Style Sheets (CSS3) technology (e.g., Google Chrome, Mozilla Firefox, Opera, Microsoft Edge, Internet Explorer). Web browsers should have a minimum screen resolution of 1024×768 pixels.
  • JavaScript and cookies enabled (typically enabled by default in browsers.
    1. STARDAPPLE SRL strives to ensure uninterrupted operation of the Website. However, to maintain service quality and efficiency, StarDapple reserves the right to schedule breaks in service. Technical interruptions may occur, during which certain functions of the Service and the services provided by us may be limited or unavailable.
    2. Users who engage in conversations with other Users through the chat function within the Service acknowledge and agree that these conversations are not private and their content may be collected and read by STARDAPPLE SRL. By accepting these Regulations, Users confirm that STARDAPPLE SRL has the right to access and analyze their communications conducted via the chat function on the Website. This is done to ensure User safety and security, prevent fraud, and enhance the Website. For more information on why and how STARDAPPLE SRL accesses and analyzes chat content, please refer to the Privacy Policy.
  1. Account:
    1. To access the full functionality of the Service, a Visitor must register an Account and use the Service as an authenticated User. The account enables the User to utilize various functions of the Website, including:
  • Browsing the content;
  • Tracking Ads from other Users;
  • Sending and receiving messages with other Users.
    1. Users can be individuals with legal capacity, legal entities, or non-legal entities authorized by law. For legal entities and non-legal entities, only authorized individuals can create an Account on their behalf and perform activities on the Website. A User can have only one Account associated with a specific email address within the Service.
    2. Generally, a User is allowed to have only one Account. The usage of aliases or multiple accounts is strictly prohibited. However, exceptions apply if the creation of a new Account is necessary due to the inability to access the old Account (e.g., forgetting the password).
    3. STARDAPPLE SRL will thoroughly examine such exceptions and reserves the right to suspend or delete the Account if the circumstances justifying the exceptions are not confirmed. These exceptions do not apply if they are used to evade payment obligations for services on the Website.
    4. Posting advertisements for non-members is not allowed, except when you, as the registered Vendor, are directly involved in the transaction as one of the parties (e.g., acting as a distributor for an artist’s resins).
    5. Registering an Account requires:
  • Completing the provided form on the Website, including providing an email address and unique password.
  • Reviewing and accepting the Regulations and its annexes.
    1. STARDAPPLE SRL handles the personal data of Users, individuals acting on behalf of Users, and Visitors in compliance with the Privacy Policy and Cookies Policy.
    2. After filling in the required registration data, an email will be sent to the User’s provided email address, containing a link to activate the Account and the current Regulations. Account activation finalizes the registration process and establishes an account service contract. If the activation is not completed within 30 days of receiving the confirmation email, the activation link will expire, and the Account will not be activated. The User can register again using the same email address after contacting us at contact@stardapple.com.
    3. The User must provide accurate, up-to-date, and valid information during the Registration process and while using the Service. The User is responsible for updating the information in case of any changes. STARDAPPLE SRL reserves the right to block an Account if the provided data does not meet the above requirements.
    4. Individuals acting on behalf of legal entities or non-legal entities with legal capacity must ensure they are authorized to act and conduct activities on behalf of the User within the Website.
    5. The User must maintain the confidentiality of the Account access data and protect them against unauthorized access by third parties. If any unauthorized access is detected, the User must promptly notify STARDAPPLE SRL and, if possible, change the account data immediately.
    6. The account service contract is valid indefinitely from the activation of the Account. The User can terminate the account service contract according to the following guidelines.
    7. Deleting the Account will not affect the User’s right to withdraw from or terminate the contract as permitted by law and the Regulations.
    8. Account deletion can be done by (i) selecting the appropriate option from the Account panel or (ii) sending a deletion notification to contact@stardapple.com.
    9. Upon deleting the Account, any other contracts between STARDAPPLE SRL and the User regarding services on the Website will also terminate.
    10. Accounts that have not been accessed for over a year may be terminated to conserve database resources.
    11. Account contract termination takes effect from the moment of execution, meaning that any payments made by the User will not be refunded.
    12. After deleting or terminating the Account, the User loses access to the provided or generated information during the use of the Service.
    13. STARDAPPLE SRL has the right to terminate the contract with the User if:
  1. the User has not accessed the Account for more than 60 months. In such cases, the Provider may delete the Account, including all personal data stored within it, rendering it inaccessible. Notice of contract termination will be sent to the User’s provided email address 30 days in advance. The User can express their intention to continue using the Account by logging in. However, STARDAPPLE SRL does not guarantee the availability of the existing username associated with the Account during new registration.
  2. Despite notifications from STARDAPPLE SRL regarding violations of the Regulations or applicable laws, the User continues to act non-compliantly.
    1. To ensure the Service’s proper functioning, safety, and protection of its users, STARDAPPLE SRL reserves the right to conduct additional checks on the User’s data validity and accuracy. STARDAPPLE SRL may request identity confirmation, information validation related to Announcements or Transactions, in a manner chosen by the company. If the verification process is unsuccessful, STARDAPPLE SRL may suspend or block the Account’s operation.
  3. Users’ Information:
    1. “Your Information” refers to any data Users provide during registration and while using Star Dapple, whether to us or other users.
    2. Users are fully responsible for the accuracy and legality of their Information.
    3. Users’ information must not be false, inaccurate, or deceptive.
    4. Users’ information must not involve the sale of counterfeit or stolen items.
    5. Users’ information must not violate any third party’s copyrights, patents, trademarks, trade secrets, rights of publicity, or privacy.
    6. Users’ information must not violate any laws, statutes, ordinances, contracts, or regulations, including those governing false advertising.
    7. Users’ information must not be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing.
    8. Users’ information must not contain obscene content or pornography.
    9. Users’ information must not contain any computer viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs, or other programming routines that may harm or disrupt systems, data, or personal information.
    10. Users’ information must not create liability for this site or result in the owner losing (partially or entirely) the services provided by her Internet Service Provider (ISP).
  4. Identity:
    1. Users’ full name, username, email address, store name, and complete valid mailing address are required. Other requested information is optional.
    2. Full, complete names must be provided, and initials are not sufficient.
    3. Accounts with invalid email addresses may be terminated.
    4. Users’ mailing address is important for accurate shipping price calculations. PLEASE NOTE: Users have the option to “hide” their email, address, about, and policy details from their store by adjusting the settings.
  5. Rules Regarding the Publication of Advertisements:
    1. STARDAPPLE SRL provides Users with the option to post Ads on the Service. Users can publish an Advertisement on the Website by completing the corresponding form.
    2. An Announcement posted by a User on the Service is accessible to all Users. Along with the Advertisement, a contact form is available, enabling Users to communicate with the User who posted the Advertisement. The User’s phone number may also be publicly displayed in the Advertisement, depending on their preference.
    3. When an Advertisement is published, the User grants STARDAPPLE SRL a non-exclusive, unlimited territorial, and free license to register, duplicate, and distribute the entire Advertisement or a portion of it within the Service. This license also allows distribution to STARDAPPLE SRL partners for promoting the Service, as well as on the Internet, including search engines (e.g., Google) or social networks (e.g., Facebook). Granting this license is necessary for full use of the Service. STARDAPPLE SRL acknowledges that it does not have complete control over the distribution of content published or transmitted through the Service to other Users, and it is not responsible for the actions of third parties, particularly regarding copying and distribution of Ads by unrelated individuals or platforms.
    4. Each Announcement must have genuine, clear, understandable content that meets the Provider’s technical requirements. Users have the freedom to determine the content of the Advertisement within legal boundaries and in accordance with the following requirements:
  6. The Advertisement must not contain vulgar or offensive language.
  7. The User must select a Category and the appropriate sub-category for the Advertisement.
  8. The User should indicate the total price in USD (including VAT, if applicable) and specify if the price is subject to auction.
  9. The User should state whether the Product is new or used.
  10. The Advertisement must include a precise, accurate, and comprehensive description of the Product, with authentic and non-misleading information about its features. Sharing this information outside the Service is prohibited.
  11. The Advertisement can only be about a property owned by the User.
  12. An Advertisement can pertain to a single item, multiple items, or a set/package (referring to a group of items that form a whole).
  13. At any given time, a single Product can be the subject of one Advertisement.
  14. The content of the Advertisement must not include promotional or advertising content, website addresses, or elements that direct Users to services similar to those provided by STARDAPPLE SRL (e.g., services for publishing offers or ads from internet users).
    1. Listing Categories include the following:
  15. Model Horses:
  16. Acceptable items include:
  • Realistic equine figurines or sculptures, whether mass-produced or one-of-a-kind.
  • Realistic animal figurines that can be used as props for model horse showing or scenes/dioramas.
  • Model horse manufacturer memorabilia (e.g., Breyer buttons, mugs, etc.).
  • Supplies or paraphernalia related to showing or customizing model horses (e.g., tackmaking supplies, airbrushes, etc.).
  • Equine media (books, magazines, videos, etc.) that may be used as reference material for collecting, customizing, or showing model horses (no fiction).
  1. Not acceptable items include:
  • Unrealistic equine figurines, including “Horse Shaped Objects” such as Barbie horses, Thelwells, and My Little Pony.
  • General horse-themed items (including horse artwork, jewelry, etc.).
  • Glassware and collector plates.
  • Plush/stuffed animals (excepting Breyer’s plush line).
  • Fiction and any other literature/media not relevant to collecting, showing, or creating model horses.
  • Real horse-related items (e.g., saddles, blankets, show clothes, actual horses, etc.). – Non-equine items (except animal figurines usable as props).
  • Fur, skins, or other dead animal products (except leather for tack making).
  • Anything in violation of applicable laws and therefore illegal (e.g., unauthorized copies of VARA-protected/copyrighted sculptures).
  1. If unsure, use common sense and consider whether the ad is related to the “Model Horse Hobby.” Comparing the similarity of the item to a Breyer model horse, which is regarded as the origin of the model horse hobby, can serve as a general guideline. Contact us at contact@stardapple.com for any clarifications.
  2. Items produced by prominent model horse manufacturers like Breyer should not be listed in the Model Horses section if they have horns, wings, molded-on tack or a rider, or if they are not equines. Such items may be suitable for the Collectible Critter category.
  3. Hobby Artist Giftware:
  • Bas-relief or 3D realistic equine resin or ceramic works produced by model horse hobby artisans for hobby purposes (e.g., medallions or plaques sculpted for show awards, pins, busts). This category does not include busts created by non-hobby artists or 2D flat art.
  1. Collectible Critters:
  • 3D, full-body, realistic animal sculptures.
  • Equines that do not fit the Model Horses criteria above (e.g., not realistic, has molded-on tack or rider, etc.).
  • Fantasy creatures, including unicorns, pegasi, dragons, etc.
    1. Listing Photos:
  • The photos accompanying advertisements must accurately depict the content of the ad. Only use photos that are either your own property, taken by you, or for which you have obtained proper permission to use. Using photos from model horse manufacturers’ websites in sales ads is considered a copyright violation and is not permitted.
  • Acceptable Photos: Photos of the actual items being advertised (must fall within the acceptable items listed in the Listing Categories section of the User Agreement and must be model horse related).
  • Not Acceptable Photos:
  1. Photos of items that fall within the list of unacceptable items in the Listing Categories section of the User Agreement.
  2. Photos of scenery, people, pets, or any other personal shots used to spam the Gallery.
  3. Photos of real horses that are not related to model horses or the acceptable listing categories.
  4. Photos that you, as the vendor, did not take and have not obtained permission to use.
  • The Star Dapple Admin reserves the right to remove inappropriate photos without notice.
  • Prior to making a purchase, it is advisable for users to utilize the Transaction board and review the vendor’s feedback available on their profile/page.
    1. Listing Frequency:

Repeated posting of ads to maintain their visibility at the top of the listings is discouraged. Reposting or renewing an ad after a week is advisable if the item remains unsold. Ads repeated within a one-week timeframe may be subject to deletion. Consistent violations of this rule may result in the termination of your account without any advance notice.

    1. The subject of the Advertisement cannot be:
  1. A request for Products.
  2. Prohibited products or any other goods whose sale is prohibited by applicable laws. This includes goods obtained through theft, goods involved in ongoing legal or administrative proceedings, or goods subject to enforced execution or part of an estate undergoing bankruptcy or insolvency proceedings.
    1. Users can modify the content and some parameters of an Advertisement or delete it during its publication period on the Service.
    2. Price changes or modifications aimed at avoiding payment to STARDAPPLE SRL for services provided within the Service or refunding funds, as specified in the Regulations, are not applicable to changes in the content of the Advertisement.
    3. After the display period of an Ad ends, regardless of the reason, the Ad is archived in the respective Accounts’ files. Users can access the archived Ad for 24 months unless they choose to remove it before the expiration of this period. Users are responsible for archiving the Advertisement content and information related to completed Transactions.
    4. All ads must be listed in an appropriate category. The Star Dapple Admin reserves the right to reassign ads to the appropriate category if they are incorrect. Inappropriate ads may be deleted without warning.
    5. Account Termination: Consistent violations of these terms may result in the termination of your account without advance notice.
  3. Auctions Policy:
    1. Both the seller and the buyer will be notified via email when an auction concludes. The buyer is informed of their win and should make the purchase.
    2. If the buyer fails to make payment, the seller has the option to relist the auction at their discretion.
    3. There may be an automatic relisting feature after a specified number of hours if the payment remains unpaid.
  4. Payment:
    1. Users who use the Service to sell products or services may be required to make payments to STARDAPPLE SRL for the services provided.
    2. Payment Release for Vendors:
      1. Withdrawal Payment Methods: Sellers have the flexibility to designate their preferred payment methods in coordination with the Buyer, herein referred to as the second party.
      2. Users are responsible for ensuring the accuracy and completeness of the payment details provided during the payment process. STARDAPPLE SRL is not liable for any errors or delays caused by incorrect or incomplete payment details provided by the User.
      3. Payments initiated by Users are eligible for a refund solely at the discretion of the seller, unless otherwise mandated by applicable law or as otherwise stated in the Regulations.
  1. Returns and Refund Policy:
    1. Star Dapple and the Vendor are not responsible if a buyer is unavailable to receive their package, leading to a missed delivery opportunity.
    2. Sellers retain the authority to initiate refunds, as specified in their respective advertisements, unless compelled by applicable law or expressly addressed in the Regulations.
    3. The Company does not offer money-back guarantees, and refunds will not be granted from the Company for any purchase, regardless of the circumstances.
  2. Delivery:
    1. The delivery of products or services purchased or agreed upon through the Service is the responsibility of the Users involved in the Transaction.
    2. STARDAPPLE SRL does not take part in the physical delivery of products or the provision of services. The Users must arrange the delivery and any associated logistics directly between themselves.
    3. STARDAPPLE SRL is not responsible for any issues or disputes arising from the delivery or non-delivery of products or services. Any claims, complaints, or disputes related to the delivery or quality of products or services should be resolved directly between the Users involved.
    4. Users are encouraged to exercise caution and use secure and reliable methods for product delivery or service provision. STARDAPPLE SRL does not guarantee the quality, safety, or legality of the products or services listed on the Website.
    5. STARDAPPLE SRL reserves the right to request proof of delivery or other relevant documentation from Users involved in a Transaction to resolve any disputes or issues related to the delivery of products or services.
  3. Restricted actions:
    1. The User is granted the privilege to utilize the Service within its intended purpose, while adhering to legal requirements and ethical practices, while respecting the rights and interests of other Users and third parties. Specifically, the User agrees to the following:
  • refrain from taking actions that may disrupt the proper functioning of the Service, including interference with the Service’s content, other Users’ Accounts, or the Service’s IT components.
  • Abstain from engaging in illegal activities, such as transmitting or publishing content through the Service that violates the law, personal rights, child pornography or terrorism, infringes upon third-party intellectual property rights, or contains discriminatory or racist content.
  • Avoid engaging in the sale of restricted products or any actions with similar effects using the Website’s features. It is also prohibited to sell products that are illegal, obtained through criminal activities such as theft, fraud, or involved in legal disputes, forced execution procedures, bankruptcy or reorganization proceedings
  • Refrain from misleading Users or STARDAPPLE SRL by providing false information about products or withholding relevant information.
  • Act in good faith and avoid misusing the Service by utilizing it contrary to its intended purpose and the regulations.
    1. The User is obligated to comply with the provisions stated in point 7.1 throughout the entire usage of the Service and in relation to all offered features, including publishing advertisements and sending messages to other Users.
    2. The automatic publication or transmission of any content on the Website occurs through the Website interface without the involvement of STARDAPPLE SRL. The Provider does not automatically monitor all content transmitted through the Website’s features.
    3. In the event that the User modifies the content of an advertisement after its publication on the Service, STARDAPPLE SRL reserves the right to edit or delete the non-compliant content according to the regulations.
    4. Every individual using the Service has the right and opportunity to report any illegal or regulation-violating content distributed through the Service’s features to STARDAPPLE SRL by emailing contact@stardapple.com. The reporting party should provide all necessary data for STARDAPPLE SRL to identify the non-compliant content, including the advertisement’s identification number, reasons for considering it illegal or contrary to the regulations, and contact details (if deemed necessary).
    5. Upon identifying non-compliance with any provisions outlined in this document through advertisements published on the Website, STARDAPPLE SRL may take the following actions:
  1. Immediately block the content, including the advertisement, and all associated promotional services. Once blocked, the content will be inaccessible to Service users, and the respective advertisement will be placed in the “Moderate” section of the User’s Account.
  2. Conduct appropriate investigations to ascertain the circumstances of the case, involving communication with the reporting party, content author, relevant authorities, or external consultants, in a proportionate and reasonable manner.
  3. Notify Professional Users about the reasons for refusal, including details of the blocked content and the violation of legal or contractual provisions, through email before the blocking takes effect. The notification may include anonymized content of abuse reports if required by law.

The provisions mentioned in clause 7.6.c) do not apply if the disclosure of information is restricted due to notifications from competent public authorities, mandatory legal provisions, or the need to ensure User protection.

    1. STARDAPPLE SRL reserves the right to delete any advertisement or block accounts if there is suspicion that they have caused or may cause harm to the security of other Service Users’ activities. The Provider also has the authority to delete an advertisement or block an account if it adversely affects the Provider’s reputation or is otherwise detrimental to the Provider.
    2. STARDAPPLE SRL retains the right to refuse account creation or block an already created account if, based on legitimate investigations, it is determined that the user or their representative has caused or may cause financial harm to the Provider.
    3. In case of severe violations of the law or repeated breaches of the Regulation, such as repeated attempts to publish or disseminate illegal content by a single User or multiple Users acting together, including using multiple Accounts, STARDAPPLE SRL may temporarily or permanently suspend or block the Account(s), which would result in the suspension or blocking of service provision. The following rules will be considered in a proportional and reasonable manner, taking into account freedom of movement:
  1. Account suspension indicates a temporary halt to its operation. Users with suspended Accounts lose the ability to actively use the Service, including sending messages and posting advertisements. However, they can still view the Service, access message and advertisement history, and manage funds in their STARDAPPLE SRL Wallet. To withdraw funds, the User must contact the Customer Support Service/Help Center via the provided email address contact@stardapple.com.
  2. Account blocking involves denying the User access to their Account.
  3. Procedure for submitting and resolving complaints and referrals:
    1. If any irregularities arise concerning the operation of the Service, including technical issues, Users or Visitors should initially contact the Customer Support Service/Help Center at contact@stardapple.com and provide relevant information to identify and address the problem.
    2. STARDAPPLE SRL strives to deliver high-quality services. However, Users have the right to submit complaints, free of charge, regarding the non-performance or inadequate performance of services provided by STARDAPPLE SRL, in accordance with the Regulation.
    3. Users can also send complaints and/or reports about illegal activities conducted by Website Users or illegal information provided by Website Users, of which they have knowledge, to the Provider at any time. Complaints can be submitted by sending a message to the address contact@stardapple.com or in writing to the postal address of STARDAPPLE SRL.
    4. Complaints and/or reports should include the User’s identification details, the identification number of the relevant advertisement (if applicable), and any other necessary data for the Provider to identify the reported event or complaint, accompanied by a detailed description. This allows the Provider to resolve the issue promptly.
    5. Complaints/reports will be reviewed and responded to within a maximum of 30 calendar days from their receipt by the Provider, provided that all necessary data to identify the User, the advertisement, and/or the problem have been provided. If the petitioner fails to provide all required information, the Provider will request the missing details, and the resolution deadline will be extended accordingly.

  4. Violations & Fraud:
    1. Breaches of the User Agreement may lead to a warning, suspension, or termination of your account.
    2. Persistent misuse, abuse, or three or more valid complaints may result in account termination.
    3. Star Dapple may suspend or terminate your account if you engage in fraudulent activity in connection with the site.
  5. Legal Compliance:
    1. You shall comply with all applicable laws, statutes, ordinances, and regulations regarding your use of the service and your listing, solicitation of offers to purchase, and sale of items.
    2. Star Dapple holds no responsibility for sales transactions or communication resulting from the use of this site.
    3. Disputes between users should be reported to local law enforcement, postmaster general, or certified mediation or arbitration entities.
  6. Disclaimer:
